Gay Globe Media Group: Commitment and Ethics

The Gay Globe Media Group is a media organization officially registered with the Quebec Enterprise Register since May 1998. Gay Globe adheres to the highest ethical standards in its publications. Although there is no legal obligation in Quebec for journalists to join associations, the main professional body in the province is the Professional Federation of Quebec Journalists (FPJQ), which offers a code of ethics on its website. Gay Globe voluntarily follows this guide in principle and uses it as a reference for managing its publications.

Right of reply and publication management

Regarding specific publications, there is no automatic right of reply. However, anyone concerned by an article can contact Gay Globe by email to provide relevant additional information about the subject, which can help correct or adjust the original content. If the information provided is deemed accurate and verifiable, Gay Globe commits to publishing these responses.

Copyright protection

All content on the Gay Globe website is protected by copyrights, officially registered with the Canadian Intellectual Property Office. Unauthorized use, modification, or distribution of original written, visual, audio, or electronic content will result in immediate civil and criminal legal action. We ask you to respect copyright laws and seek permission before using protected materials.

Fair use exception

However, Canadian copyright law provides an exception known as fair use, which allows journalists or students to use portions of our content for reviews or reports under strict conditions. Additionally, the news feed Le Point may reference or publish news from external sources, provided proper attribution is given.

Privacy protection principles

Due to the importance of preserving the confidentiality of personal information, the Gay Globe website operates according to the following principles:

  • The Gay Globe website is not used as a tool to collect personal information (name, address, email, or any other information that can identify a person).
  • In some cases, however, Gay Globe may ask the user to subscribe. The user may decline this request; if accepted, the information provided will mainly serve the following purposes:
    • Helping Gay Globe ensure the relevance of its website by adapting content to the user’s needs based on their country of origin;
    • Helping Gay Globe evaluate and improve the website by using collected information to enhance content, interface, and aid in developing new services;
    • Allowing Gay Globe to maintain decency and quality in discussions and forums;
    • Informing the user of any news or event that may interest them if they subscribed.
  • If the user agrees to subscribe, Gay Globe will never disclose this personal information to third parties, except by combining it with information provided by other users, making it impossible to identify a specific user. For example, the user’s name and address will not be disclosed, but it may be announced that 62% of the site’s users live in Montreal.
  • Users who prefer not to subscribe still have access to most website sections. However, they cannot access sections requiring login or paid services.

The Personal Information Protection and Electronic Documents Act (PIPEDA) is defined as follows: The law aims to facilitate and promote electronic commerce by protecting personal information collected, used, or disclosed in certain circumstances. It also provides for the use of electronic means to communicate or record information and transactions, amending the Canada Evidence Act, the Statutory Instruments Act, and the Interpretation Act.

For the purposes of applying the Personal Information Protection and Electronic Documents Act, the term “document” includes all information items, regardless of form and medium, such as correspondence, notes, books, plans, maps, drawings, diagrams, illustrations, graphics, photographs, films, microfilms, sound recordings, videocassettes or computer records, as well as any reproductions of such information items. The term “personal information” means any information about an identifiable individual, except for the individual’s name and job title as an employee of an organization, as well as their professional address and telephone number.


Policy Statement

Gay Globe has adopted a policy to manage the collection, use, and disclosure of personal information in accordance with the standards established in the Personal Information Protection and Electronic Documents Act. In certain situations, personal information may be collected, used, or disclosed without the individual’s consent and knowledge. These exceptions include, but are not limited to, cases where personal information is collected:

  • For legal, medical, or security reasons;
  • For fraud detection and prevention or law enforcement;
  • For journalistic, artistic, or literary purposes.

Requirements

Gay Globe must comply with the following principles, except for exemptions under the Personal Information Protection and Electronic Documents Act:

  • Accountability: Gay Globe is responsible for the personal information it manages and must designate a Privacy Management Coordinator to ensure compliance with the law within the organization.
  • Purpose of collection: The purposes for which personal information is collected must be determined by Gay Globe before or at the time of collection.
  • Consent: Individuals must be informed of the collection, use, or disclosure of their personal information and must consent.
  • Limiting collection: Gay Globe must only collect personal information necessary for the identified purposes.
  • Limiting use, disclosure, and retention: Personal information must not be used or disclosed for purposes other than those for which it was collected, unless the individual consents or the law permits. It must only be retained as long as necessary to fulfill the identified purposes.
  • Accuracy: Personal information must be accurate, complete, and up to date for the purposes for which it was collected.
  • Safeguards: Personal information must be protected by security measures appropriate to its sensitivity.
  • Openness: Gay Globe must provide clear information about its policies and practices regarding personal information management, which must be readily accessible.
  • Individual access: Gay Globe must inform individuals upon request of the existence, use, and disclosure of their personal information and provide access to it. It must also allow individuals to challenge the accuracy and completeness of the information and have it amended if necessary.
  • Right to file a complaint: Individuals have the right to file a complaint regarding non-compliance with these principles by contacting the responsible persons at Gay Globe.

Responsibility and Enforcement

All employees of Gay Globe who collect, store, or use personal information must ensure these activities are conducted according to this policy and appropriate procedures. The Editorial team is responsible for ensuring compliance by establishing procedures, guidelines, and timelines for implementing this policy. The Privacy Management Coordinator is in charge of Gay Globe’s personal information policies and practices. Any complaints or information requests should be addressed to this person.

Privacy Standards

Provisions relating to the protection of personal information are based on the CSA International Model Code for personal information protection, recognized as a national standard in 1996. This standard describes how organizations can collect, use, and disclose personal information and addresses individuals’ rights to access their personal information and correct it if necessary. These principles, subject to some exceptions, are outlined in the Act and Gay Globe’s Privacy Policy.

The ten principles set out in the Code are as follows:

  • Accountability: An organization is responsible for personal information under its control and must designate one or more persons to ensure compliance with the principles below.
  • Identification of purposes for personal information collection: The purposes for which personal information is collected must be identified by the organization before or at the time of collection.
  • Consent: Individuals must be informed of any collection, use, or disclosure of personal information concerning them and must give consent unless it is inappropriate to obtain consent.
  • Limiting collection: The organization may only collect personal information necessary for the identified purposes and must do so fairly and lawfully.
  • Limiting use, disclosure, and retention: Personal information must not be used or disclosed for purposes other than those for which it was collected unless the individual consents or the law requires. Personal information must only be retained as long as necessary to fulfill the identified purposes.
  • Accuracy of information: Personal information must be as accurate, complete, and up to date as necessary to fulfill the purposes for which it is used.
  • Safeguards: Personal information must be protected by security safeguards appropriate to the sensitivity of the information.
  • Openness: An organization must ensure that clear information about its policies and practices related to personal information management is readily available to all.
  • Individual access: Upon request, an organization must inform individuals of the existence, use, and disclosure of their personal information and provide access to it. Furthermore, individuals must be allowed to challenge the accuracy and completeness of their information and request appropriate corrections.
  • No personal information retained: No personal information regarding visitors is retained in our systems or on our website.

Tax Treatment for Clients Outside Canada

All rates are expressed in Canadian dollars and are listed exclusive of applicable taxes.

Services provided to companies located outside Canada may be invoiced at a 0% rate (zero-rated supply), in accordance with applicable Canadian tax legislation. Confirmation of non-resident status may be required.

The client declares and warrants that it is a non-resident entity of Canada for the purposes of the Excise Tax Act (GST/HST) and, where applicable, the Quebec Sales Tax Act (QST), and that it is not registered for these taxes in Canada.

To the extent that the services supplied under this agreement qualify as a zero-rated supply under applicable Canadian tax legislation, no GST/HST or QST will be charged.
